7. Generalities. If a provision of this agreement is found to be unenforceable, it does not affect the applicability of the other provisions. This agreement is governed by the laws of the State of New York and the United States, regardless of the rules of conflict of laws. The rights and obligations of the parties to this ECJ are not governed by the UN Convention on the International Sale of Goods. As is the case here, “EULA” means an end-user license agreement, and “software” means Linux programs as defined in this term. 1.3 Intellectual property rights. RHDS, ESC, AEP and each of their components, including source code, documentation, appearance, structure and organization, are owned by Red Hat and others and are protected by copyright and other laws. Ownership of HRSD, ESC, AEP and any components, or copies, modifications or merged parts remains subject to the corresponding license. The “Red Hat” brand and the “Shadowman” logo are registered trademarks of Red Hat in the United States and other countries. This CLA does not allow the user to market HRSD, ESC or AEP using Red Hat`s trademarks. The user must read the information found on before distributing a copy of these programs, whether they have been changed or not.

The user may only make a commercial redistribution of HRSD, ESC or AEP if (a) a separate agreement with Red Hat authorizing such commercial redistribution is executed, or if another written authorization is granted by Red Hat, or (b) the user changes all files marked “REDHAT-LOGOS” to remove and replace all images that contain the “Red Hat” or “Shadowman” logo. Simply deleting these files can damage programs. 3. Restricted warranty. Except in this section 3, a separate agreement with Red Hat or a license for a particular component, in accordance with existing legislation, programs and components are made available and granted without explicit or tacit guarantees “as intended,” including tacit guarantees of cashing, non-counterfeiting or suitability for a specific purpose. Red Hat ensures that the media on which the programs and components provide are free of hardware and manufacturing errors in normal use for a period of thirty (30) days from the date of delivery to the user. Red Hat does not guarantee that the functions contained in the programs meet the user`s needs or that the operation of the programs is completely bug-free, as stated in the accompanying documentation or complies with legal requirements. This guarantee applies only to the party who acquires services related to Red Hat programs or an authorized Red Hat distributor. Red Hat Linux is a modular operating system made up of hundreds of individual software components, each written individually and copyrighted.

In this document, these components are called “Linux programs” individually and collectively. Each Linux program has its own valid end-user license agreement.
